Runaways are permitted to work in the UAE without being imprisoned. But first, they must contact their creditor, and they must clear their records if an arrest warrant has been issued or a case is still pending.
- Find a Representative: Appoint a lawyer or other authorized representative in the UAE to confirm whether any complaints have been made against you and to communicate with the lenders on your behalf. Banks typically accept a simple authorisation letter specifying the account details of the client and the representative, but any representative, including legal experts, may need to produce a Special Power of Attorney.
- Negotiate with the bank: Unpaid amounts and the conditions of your credit are subject to change. Banks are open to new payment methods because getting their money back is their top priority. For instance, if you owe Dh200,000 but can only afford to pay Dh140,000, you might be able to persuade the bank to waive the fines and penalties and reduce your debt to Dh200,000. A new payment schedule can also be agreed upon. But there’s a catch with choosing a non-attorney representation. He might not be in a position to persuade the bank to significantly lower the unpaid balance. “The banks won’t just let their fines and penalties go. To be able to negotiate for a reduced payment, the negotiator should be able to reference pertinent laws and viable defenses, according to Barney Almazar, director of the corporate-commercial department at Gulf Law Middle East, Philippines, and United Kingdom.
According to Paul Hughes, legal director of commercial litigation at Addleshaw Goddard Middle East, “It is possible to appoint a representative other than a lawyer to assist you (unless the particular case is likely to involve the courts and/or the public prosecutor, in which case it would be advised to engage a lawyer).”
- Put down everything in writing: Once a verbal agreement has been made, get a settlement agreement created by the bank so that everything is documented and signed. Before transferring the payment, this must first be signed or released. This document needs to be on the bank’s letterhead, duly signed by a bank representative, and sealed with the bank’s seal.In the absence of a written or verbal agreement, do not ever give the money. This document serves to safeguard the borrower by preventing the bank from requesting payments in the future that are greater than the agreed upon sum. It’s not necessary to sign this in front of a police officer. Whether or not there is a court case, police complaint, or arrest warrant, this should be obtained.According to our observations, people who were offered cheaper costs were afterwards asked for additional payments. The bank representative would argue that the consumer needed to add more money since the management had not approved the discount, according to Almazar.
“Since the agreement with the bank wasn’t in paper, the consumer will have a tough time proving it. Usually, the request for more money is made after the original employee who established the arrangement has left or been transferred to another department, leaving the customer in a difficult situation.
How do fled borrowers clear their identities and go back to the UAE? Hughes issued a warning, saying that the settlement agreement does not necessarily absolve the borrower of all legal obligations. In order for the arrest warrant to be lifted, the creditor will need to take action to revoke the police report, Hughes stated.
- Ask for a clearance letter and “release” document: You must obtain at least two documents from the bank to clean your records after the payment has been paid. The clearing paper will serve as evidence that you have paid all of your creditors’ outstanding balances. The police would need this proof to drop any charges they had brought against the borrower, so this will also be helpful to people who have cases that are still ongoing. The clearance letter may be issued by the bank the same day or the day after, or it may take up to two weeks. The “release” paperwork will demonstrate that the bank has dropped its claim against the client. On the same day that you seek the clearance certificate, you might get the paper.”The process may take around two weeks as they do this in batches if your settlement with the bank includes the bank itself clearing your records with the police on your behalf (meaning, you don’t need to go to their lawyers and the police. If your representative completes it personally, the bank’s clearance may require a day or more, or he may choose to wait for it to be issued the same day. You can also personally acquire your release from the attorney on the same day that you visit their office.
- Submit the release paper to the authorities: In order to verify that your lender is no longer after you, your representative must go to the police station where the matter has been reported and turn over the release form, according to Almazar.
- Obtain a police clearance certificate: Your representative might proceed to the police main headquarters to submit an application for a clearance after the case has been resolved at the police station level, if necessary. It’s simply optional, according to Almazar, to obtain a police clearance. “The person can enter UAE without any issues once the case has been resolved with the police (the police will delete it from the system and give a verbal confirmation). However, you can ask for a police clearance certificate if you’d rather have official evidence that you have no cases against you.
To begin the process of obtaining a police clearance certificate, one must contact the nearest UAE embassy. “Fingerprinting will be required, and your documents must be validated. You will next need to give a power of attorney to your agent in the UAE so they may submit the application to the police, according to Almazar. - Travel back to UAE: You are now prepared to resume your life in the UAE after obtaining all the necessary paperwork. Make sure you have the papers with you when you get back. Your immigration and police records would have been cleared by this point. (GN).
